A patient’s frequent falls in nursing home generally lead to rain injury and eventually death. With incidents like this, the nursing home and its staffs are held responsible. In addition, the patient and its family will generally institute legal action. In the state of New York, nursing home residents are being provided y the government special rights and legal protection against those negligent nursing homes that fails to do their duties for the safety of their patients.

One great example of this what we call as poor care by nursing homes and its staffs that eventually caused to tragic of a patient has been reported in the Los Angeles Times. Reports said that a nursing home in Northern California was fined $100,000 after the State investigates the case and found out that a certain staff in the reported nursing home failed to prevent its patients from falling twice that resulted the patient to suffer a fatal head injury and was not treated.

The investigators of the State found out that the 85 years old patient who has been suffering from diabetes and heart condition was supposed to be on a walker and must be under supervision while walking. However, the investigators further discovered that the nursing home staff was not able to install an electronic fall monitor as per order by the patient’s doctor. In addition, the staff also failed the make sure that the walker of the patient was within reach.

According to the note of the nursing home staff, the patient has hit his head and undergone a neurological evaluation and had appeared normal. However, the patient denied these notes of the staff. When he started to turn pale, listless and started vomiting on the night after the incident, staff members of the said nursing home failed to assess him for possible head injuries or notify his doctor for about two hours. This is also partly because there was no registered nurse on duty by the time that incident happen, which was found according to the patient’s medical records.

By the time staff members notified the doctor and nephew of the patient, they immediately had the patient transferred to a hospital. Sadly, the man died the next morning. Using a CT scan, the doctors determined the cause of death was bleeding in the brain, which is according to the investigator’s medical report due to fall with head trauma.

For cases like this, patients and their family can seek assistance to brain or head injury law firms for their head injury compensation.
